This website is operated by E. MAIER LLC, a Wyoming limited liability company doing business as Toevida. Throughout the site, the terms "we", "us" and "our" refer to Toevida and E. MAIER LLC. We offer this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and policies referenced herein and/or available by hyperlink, including our Privacy Policy, Refund Policy and Shipping Policy. These Terms apply to all users of the site, including browsers, customers, merchants and contributors of content.

Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

Certain products may be available exclusively online through the website and may have limited quantities. They are subject to return or exchange only according to our Refund Policy.

We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate. Sizes are approximate; please use our size chart before ordering.

Product use and health disclaimer. Our socks are general-use athletic apparel designed to reduce friction and moisture between the toes. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition. Results vary with footwear, activity, foot shape and conditions, and we do not guarantee that you will never get a blister. If you have diabetes, neuropathy, poor circulation, an open wound, an infection or another foot condition, consult a healthcare professional before use.

We reserve the right to limit the sales of our products to any person, geographic region or jurisdiction, and to limit quantities. All descriptions of products or product pricing are subject to change at any time without notice. We do not warrant that the quality of any products purchased by you will meet your expectations, except as expressly stated in our Refund Policy.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order, including orders that appear to be placed by dealers, resellers or distributors. If we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address provided at the time the order was made.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update it as needed so that we can complete your transactions and contact you as needed.

Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless E. MAIER LLC and our members, managers, employees, affiliates, agents and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement. These Terms are effective unless and until terminated by either you or us. If in our sole judgment you fail to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice and may deny you access to our Services.

SECTION 17 - ENTIRE AGREEMENT

These Terms and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 18 - GOVERNING LAW, ARBITRATION AND CLASS ACTION WAIVER

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

Before filing a claim, you agree to contact us at support@toevida.com and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved informally will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. You and we agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any class, consolidated or representative proceeding. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase with the subject line "Arbitration Opt-Out". Subject to the arbitration agreement, the state and federal courts located in Laramie County, Wyoming shall have exclusive jurisdiction.
